A potential client called about a breach of contract action she wants to pursue. The caller does not live in California, and for reasons not important to the story, it is not feasible to sue the defendant where he resides. The caller was intending to move back to California, and wanted to know if the action could be there. The following discussion ensued.
“That depends. For a breach of contract action, you can sue the defendant in one of three places. You can sue where the contract was entered into, where it was to be performed, or where the defendant resides. Where did you sign the contract?”
“On page five.”
